Man arrested in Texas for November slaying Officials are working to extradite suspect By Joseph Ruzich | Special to the Tribune September 19, 2007 A Melrose Park man living in Texas was arrested by U.S. marshals in the death of a Proviso East High School student found in a Maywood alley last year. The Cook County state's attorney's office said it will charge Emilio Rodriguez, 25, with first-degree murder in the shooting death of Gerardo Garcia, 18, of Maywood once Rodriguez is extradited to Illinois. He was arrested Friday on a warrant signed by Cook County Judge William Wise on Sept. 6, said Maywood detective Dan Zimmermann. Garcia, who was planning on getting married this year, according to friends, was found shot in the head in an alley in the 700 block of North 7th Avenue early on Nov. 10. Maywood police said the slaying was gang-related. "The victim's family played a large part in solving the case," Zimmermann said. "Whenever they heard something on the street, they would let me know about it." At the time of his son's slaying, Eduardo Garcia said: "I want the people who did this found and brought to justice. I want to see them put in jail. I want justice for my son." Garcia could not be reached for comment on Tuesday. Zimmermann said Rodriguez first fled to Mexico, then moved to a family member's home in Austin, Texas. When the warrant was issued, the U.S. Marshals Office in Austin was asked to arrest Rodriguez, Zimmermann said. Hector Gomez, supervisor deputy for the U.S. Marshals Office in Austin, said the arrest mostly went smoothly. "The problem was trying to identify him," said Gomez, whose team was working off a photo taken two years ago. "What helped us identify him were the tattoos on his right arm." Authorities tried to arrest Rodriguez at his home Friday morning but could not make a positive identification. "So we monitored him throughout the day at his place of work [at a construction company]," Gomez said. "In the evening, we saw him roll up his sleeves while he was taking tools off a truck. His tattoos confirmed it was the guy." Gomez said Rodriguez was trying to establish himself in Texas. "Our investigation showed that he had a driver's license and a work history," he said. The next step is extradition. Gomez said the State of Illinois must pick up Rodriguez within 10 working days if he signs a waiver admitting he is the person on the warrant. He can also fight the extradition but must prove that he is not the individual, Gomez said.
